Understanding Georgia Reserve Study Requirements

Georgia law does not require homeowners associations (HOAs) or condominium associations to obtain a Reserve Study or maintain a specific level of reserve funding. Instead, reserve funding responsibilities are generally established by an association’s declaration, bylaws, covenants, and board policies.

The Georgia Condominium Act (O.C.G.A. § 44-3-70 et seq.) requires condominium associations to prepare annual operating budgets and provide certain financial information during condominium resale transactions, including reserve-related budget information. However, the Act does not require associations to perform a Reserve Study or maintain minimum reserve funding levels.

Many homeowners associations in Georgia are governed by the Georgia Property Owners’ Association Act (O.C.G.A. § 44-3-220 et seq.), which establishes requirements for community governance, assessments, and association operations.
