Understanding Georgia Reserve Study Requirements

Atlanta-area condominium associations and homeowners associations are not subject to a statewide requirement to obtain a Reserve Study or maintain a prescribed reserve balance. Instead, an association’s reserve responsibilities are generally determined by its governing documents, budget policies, maintenance obligations, and the Georgia statutes that apply to the community.

The Georgia Condominium Act (O.C.G.A. § 44-3-70 et seq.) requires condominium associations to prepare annual operating budgets and provide certain financial information during condominium resale transactions, including reserve-related budget information. However, the Act does not require associations to perform a Reserve Study or maintain minimum reserve funding levels.

Many homeowners associations in Georgia are governed by the Georgia Property Owners’ Association Act (O.C.G.A. § 44-3-220 et seq.), which establishes requirements for community governance, assessments, and association operations. While the Act authorizes associations to collect assessments for the maintenance and replacement of common property, it does not require Reserve Studies or prescribe minimum reserve fund balances.
