Are Reserve Studies Required in Kentucky?

Kentucky does not currently impose a blanket statewide requirement that every condominium association or homeowners association obtain a formal Reserve Study on a fixed schedule. However, Kentucky law does establish important financial, budgeting, recordkeeping, and reserve-related responsibilities that make professional reserve planning a valuable tool for many communities.

For planned communities governed by the Kentucky Planned Community Act, an association’s board generally must adopt an annual budget for revenues and expenditures. Kentucky law specifically provides that the budget may include reserves to fund the future repair and replacement of capital goods in the normal course of operations.

Condominium associations are governed separately under the Kentucky Condominium Act. Among other requirements, Kentucky law addresses association financial reporting and disclosures involving anticipated capital expenditures and existing reserves. For example, certain condominium resale disclosures must identify capital expenditures anticipated for the current and, if known, the following two fiscal years, as well as the amount of reserves for capital expenditures and amounts designated for specific projects.
